Dear Tri-Valley Students:
It looks like ICE has “considered the possibility” of allowing students to reinstate on a so-called “case by case basis. . . .” and they have decided that they’d rather refuse to allow colleges to issue I-20’s, and they want to give every single student an NTA and deport them.
Some Tri-Valley students are perfectly happy calling the SEVP Response Center (I like to call it “dial-an-NTA”) and signing away their rights. They are welcome to do so, and I wish them luck.
However, some students actually didn’t do anything wrong, and don’t feel like they should pay for TVU’s mistakes. These students attended the online classes. They trusted their DSO. And they are legitimate students who merely wish to continue their education and career. For these TVU victims, we have begun to prepare a federal lawsuit against the government on their behalf. As we have been saying since Day 1, ICE did not do a good job on this bust. And ICE is treating students in a manner that is illegal. As we look carefully, we are even beginning to suspect that ICE doesn’t have the regulatory power to do what they did.
Since we intend to file suit in the Eastern District of Pennsylvania, we’re interested in students whose address is in Pennsylvania. But even if you are outside of this area, you may still be included. We do also intend to pursue fees under the Equal Access to Justice Act, meaning if we prevail then the US government will pay attorneys fees and court costs. And let students be students again.
