For few years now we have been fighting for the H4 EAD rule and we have always requested that the rule be cleared through Executive powers which means directly through the office of the President.  The rule has been pending and a group of very determined people have continuously fought for this rule under guidance.  We have done radio shows, Youtube videos and even a movie and have contacted many advocacy group and news media on the matter.

The way the rule works is a very interesting process where Congress literally has no big say on the matter. As we all know Congress has been stalling on any immigration matters and luckily President Obama has been pushing the agenda through executive powers.  These are the steps that a rule usually take.

Step 1: Initiating Events – meaning starting the event.

Step 2: Determination whether a Rule is Needed – there is a process where an analysis is done whether this rule is required or not.

Step 3: Preparation of Proposed Rule – in this case the H4 rule was prepared in 2011.

Step 4: OMB Review of Proposed Rule – In the H4 EAD case, this rule was cleared on May 7th 2014

WHAT ARE THE STEPS LEFT

Step 5: Publication of Proposed Rule – the rule will be published on regulations.gov

Step 6: Public Comments – now we need to see how the public will react. Meaning anybody can comment on the said rule.

Step 7: Preparation of Final Rule, Interim Final Rule or Direct Final Rule – a final version will be prepared.

Step 8: OMB Review of Final Rule, Interim Final Rule or Direct Final Rule – the office will review the rule

Step 9: Publication of Final Rule, Interim Final Rule or Direct Final Rule – once finalized it will be made law under the CFR.

The above is a simplistic way to approach the situation at this point almost 5 more steps are left and we urge all of you to continue signing the petition.
